Justice Qazi Faiz Issa Case: What options did the President of Pakistan Arif Alvi have?

Is the office of the head of state, i-e the President of Pakistan, just a post office in Pakistan? This question has become very important after the Supreme Court gave a detailed verdict in the case of Supreme Court Judge Qazi Faiz Issa and the language is very special and common.




The general impression is that the position of head of state in Pakistan is nothing more than a 'suspended member'. No wonder the President of Pakistan had the same idea in mind when the Presidency was approving the filing of a reference against Justice Qazi Faiz Issa.

Some believe that the formality of the presidency is created by the parliamentary system, which the 18th Amendment reinforced that the president has to do whatever the prime minister wants. But is that really the case?

In 2018, the interim government made a big decision. The government wanted its legal officers, the Deputy Attorney General and the Assistant Attorney General, to be replaced. To this end, the Prime Minister's Office sent a summary to the Presidency requesting approval of the new appointments.

It was a major decision that was expected to have profound and far-reaching effects at the administrative and political levels. In addition, an interim government with a mandate to hold elections should not be involved in such dismissals and appointments. The President sent the summary back to the Prime Minister's Office with several constitutional and legal objections.

The Prime Minister accepted the objections and did not insist on removing the old legal officers and appointing new ones.
